Terms of Use

1. Definitions

"We," "Us," "Our" refers to DracoChinese, the operator of the App.

"You," "Your," "User" refers to the individual accessing or using the App.

"App" refers to the DracoChinese mobile application available on iOS and Android platforms.

"Services" refers to all features, content, and functionalities provided through the App.

"Content" refers to all text, images, audio, video, articles, vocabulary, and other materials available in the App.

"Premium Subscription" refers to the paid subscription tier that provides enhanced features.

"Free Tier" refers to the basic access level with limited features and advertisement support.

2. Eligibility

Age Requirements

You must be at least 13 years old to use DracoChinese. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use the App.

For Users Under 13:

• The App is not intended for children under 13
• We do not knowingly collect information from children under 13
• If we learn a user is under 13, we will terminate the account

Account Responsibility

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information when creating an account
• You must notify us immediately of any unauthorized use of your account

Account Creation

• Provide a valid email address
• Create a secure password (if using email registration)

Account Security

Your Responsibilities:

• Notify us immediately of any security breach

Limitations:

• Usage limits on certain features

Premium Subscription

Enhanced Features:

• Unlimited access to all articles
• Full access to all vocabulary libraries
• Unlock all missions and levels
• OCR character scanning feature
• Ad-free experience
• Priority access to new features

5. Subscription and Billing

Payment Terms

Subscription Plans:

• Monthly subscription
• Annual subscription
• Prices displayed in your local currency

Billing:

• Charged through App Store (iOS) or Google Play (Android)
• Payment processed at confirmation of purchase
• Automatic renewal at the end of each billing period
• Price may vary by region and platform

Automatic Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

To Cancel:

• iOS: Settings → [Your Name] → Subscriptions
• Android: Google Play Store → Subscriptions

6. Acceptable Use Policy

Permitted Uses

You may use DracoChinese for:

• Personal Chinese language learning
• Educational purposes
• Self-improvement and skill development

Prohibited Activities

You May NOT:

Account Violations:

• Create multiple accounts to circumvent limitations
• Share your account with others
• Use another person's account without permission
• Impersonate any person or entity

Technical Violations:

• Attempt to gain unauthorized access to the App or our systems
• Reverse engineer, decompile, or disassemble the App
• Use automated tools (bots, scrapers) to access the Services
• Interfere with or disrupt the App's functionality

Content Violations:

• Copy, reproduce, or redistribute our Content without permission
• Remove copyright notices or proprietary markings
• Use Content for commercial purposes without authorization

Child Safety Policy

DracoChinese is committed to child safety and strictly prohibits:

• Child Sexual Abuse and Exploitation (CSAE) content of any kind
• Any content that sexualizes, exploits, or endangers minors
• Grooming behavior or any attempts to contact minors for inappropriate purposes

If we become aware of any Child Sexual Abuse Material (CSAM) or CSAE content, we will:

• Immediately remove the content and terminate the associated account
• Report to the National Center for Missing and Exploited Children (NCMEC) or relevant regional authorities
• Cooperate fully with law enforcement investigations

7. Intellectual Property Rights

Our Rights

Ownership:

• We own all rights, title, and interest in the App and Services
• All Content is protected by copyright, trademark, and other intellectual property laws
• "DracoChinese" name and logo are our trademarks

Your Rights

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the App for personal, non-commercial purposes
• View and study Content within the App
• Use features as intended

Restrictions:

• You may NOT sell, license, or distribute our Content
• You may NOT use Content for commercial purposes
• You may NOT remove or alter copyright notices

8. Third-Party Services

DracoChinese integrates with third-party services:

Backend Services:

• Supabase (database and authentication)

Payment Processing:

• Apple App Store (iOS subscriptions)
• Google Play Store (Android subscriptions)
• RevenueCat (subscription management)

Advertising:

• Google AdMob (for free-tier users)

Content Services:

• Google Cloud Text-to-Speech
• Youdao Dictionary API
• Tencent OCR Service
• Cloudflare CDN

9. Disclaimers and Limitations of Liability

Educational Purpose

DracoChinese is for educational purposes only. We do not guarantee language proficiency or fluency. Learning outcomes vary by individual effort and dedication.

Service Availability

Limitation of Liability

To the Maximum Extent Permitted by Law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• For free-tier users, liability is limited to $100 USD

10. Indemnification

You agree to indemnify and hold harmless DracoChinese and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the App
• Your violation of any rights of another person or entity
• Your violation of applicable laws or regulations

11. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Dispute Resolution

Informal Resolution

Before filing a claim, please contact us to attempt informal resolution. Provide a detailed description of the dispute and allow 30 days for good-faith negotiation.

Time Limitation

Claims must be filed within one year of the claim arising. Claims filed after one year are barred.

13. General Provisions

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and DracoChinese regarding use of the App.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Updates to Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification or email. Continued use after changes constitutes acceptance.
